Kimberly Marasco initially filed a lawsuit against Taylor Swift Productions Inc. in April, seeking a nominal sum of $100. The case was later elevated from small claims court to the Southern District of Florida, under the oversight of Trump-appointed Judge Aileen Cannon. Marasco has expanded her claim, requesting more than $7 million in damages, and cited over a dozen songs from Taylor Swift’s albums 'Lover', 'Folklore', 'Midnights', and 'The Tortured Poets Department', alleging that Swift incorporated themes and texts from her poems Fallen from Grace and Dealing with Chronic Illness: Vestibular Neuritis.

Marasco also asserts that Taylor Swift’s choreography for 'Vigilante Shit' during the Eras Tour mirrors a dance routine she created. The lawsuit took months to serve, with Florida’s secretary of state assisting in December. Marasco has additionally authored Swift Reflections: Poetry Inspirations, highlighting what she perceives as direct similarities between her poetry and songs such as 'Getaway Car', 'The Man', and 'Right Where You Left Me'. The case finally came to a close with the verdict in Taylor Swift's favor.
